18.082 Inclusion of unlisted territory in contiguous districts.Any portion of the state which is not stated in this act as being included in any district described in this act but which is entirely surrounded by a district shall be deemed to be included within the surrounding district. Any portion of the state which is not included in any district described in this act and which is not entirely surrounded by a district shall be included within that district contiguous to such portion that contains the least population per representative according to the United States Decennial Census of 2010; however, if every district contiguous to such portion has an equal population, such portion shall be included within the lowest-numbered district that is contiguous to such portion.

1Note.On July 9, 2015, the Florida Supreme Court held portions of the congressional district map unconstitutional in The League of Women Voters of Florida v. Detzner, 172 So. 3d 363 (Fla. 2015), and relinquished the case to the trial court with directions to the Legislature to redraw districts 5, 13, 14, 21, 22, 25, 26, 27, and all other districts affected by the redrawing. The Legislature was unable to produce a map, and the districts were determined by court order in Romo v. Detzner and Bondi and The League of Women Voters of Florida v. Detzner, Case Nos. 2012-CA-00412 and 2012-CA-00490, Fla. 2d Jud. Cir. Ct., October 9, 2015; the final congressional redistricting plan was approved by the Florida Supreme Court, The League of Women Voters of Florida v. Detzner, No. SC14-1905 (Fla. December 2, 2015).
